- Definitions
1.1 When the following words with capital letters are used in these Terms, this is what they will mean:
Event Outside Our Control: as defined in clause 12.2;
Goods: the goods that We are selling to you as set out in the Order;
Order: your order for the Goods and/or Services;
Product: the product We create for you as a result of the Services, as set out in the Order;
Services: the services that We are providing to you as set out in the Order;
Terms: the terms and conditions set out in this document; and
We / Our / Us: Bespoke Sales Limited, a company registered in the United Kingdom with registration number 10413239, whose registered office is at 5–7 Downham Road, Ramsden Heath, Billericay, CM11 1PU.

1.2 When We use the words “writing” or “written” in these Terms, this will include email unless We state otherwise.
Your contract for purchases made through the Site is with Bespoke Sales Limited trading as Affordable Pools, and you undertake that all goods ordered by you are for your own private and domestic use only unless otherwise agreed with Us in writing.
No contract for the sale of any product shall exist between you and Us unless and until We accept your Order by email confirming receipt of full payment. Acceptance is deemed complete at the time the email is sent, whether or not it is received. This confirmation email constitutes acceptance of your offer to purchase goods from Us or a third-party supplier acting on Our behalf.
You must check the confirmation email carefully and retain a copy. We will not pass your personal or payment details to any third party and will comply with the Data Protection Act 1998. All purchases are non-exchangeable, non-refundable, and non-transferable, except where statutory rights apply.
- Our Contract With You
2.1 These Terms govern the supply of Goods, Services, or both to you.
2.2 Please read these Terms carefully and check that the Order details are accurate before submitting it. If you believe there is an error, please contact Us. Any changes will be confirmed in writing.
2.3 Submitting an Order does not constitute acceptance. Acceptance occurs only in accordance with clause 2.4.
2.4 A binding contract is formed when We confirm in writing that We can supply the Goods and/or Services.
2.5 An order number will be issued upon confirmation and must be quoted in all correspondence.
2.6 Our website, catalogue, and brochure are for promotional purposes only.
2.7 Images are illustrative only. Actual Goods may vary slightly.
- Changes to Orders or Terms
3.1 We may revise these Terms to reflect:
(a) changes in law or regulation;
(b) changes in suppliers or manufacturers.
3.2 We will give you as much notice as possible of any changes. You may cancel under clause 13.4(c).
3.3 Orders may be amended before dispatch or service commencement (excluding made-to-measure Goods). Price changes will be confirmed in writing.
3.4 Made-to-measure Goods cannot be cancelled once manufacturing has begun.
Colour swatches shown online may not match actual gel coat finishes due to lighting and screen variations. Physical swatches should be requested.
- Made-to-Measure Goods
4.1 Goods are manufactured using measurements provided by you.
4.2 Incorrect measurements supplied by you may result in non-refundable Goods. This does not affect your statutory rights for faulty or misdescribed items.
- Delivery of Goods
5.1 Delivery times and charges vary by location and availability.
5.2 Estimated delivery and installation dates will be provided.
5.3 Storage is limited. Initial storage is free; extended storage may incur charges.
5.4 Failed delivery attempts may incur redelivery fees.
5.5 Delivery is complete upon arrival at your specified address.
5.6 Ownership transfers upon receipt of full payment.
- Faulty Goods
6.1 Your statutory rights apply to faulty or misdescribed Goods.
- Seller’s Guarantee
7.1 We guarantee Goods upon delivery.
- Providing Services
8.1 Services commence on the date specified in the Order.
8.2 Delays may occur due to Events Outside Our Control.
8.3 Failure to provide required information may result in additional charges or suspension.
8.4 Services may be suspended for technical or improvement reasons.
8.5 Non-payment may result in suspension of delivery.
8.6 All intellectual property rights remain with Us.
- Problems With Services
9.1 Defects must be reported promptly and allow Us reasonable opportunity to remedy.
9.2 Statutory rights for Services apply.
- Price and Payment
10.1 Prices are as listed at time of Order.
10.2 VAT changes will be applied if applicable.
10.3 A 50% deposit is required to commence manufacturing. Payment schedules vary by project type.
10.4 Late payments incur interest at 5% above Barclays Bank base rate.
10.5 Disputed invoices suspend interest charges.
10.6 Manufactured pools are subject to non-refundable deposits. Storage costs after receipt are chargeable.
- Our Liability
11.1 We are liable only for foreseeable losses.
11.2 Goods and Services are for domestic use only.
11.3 We do not exclude liability for fraud, statutory breaches, or defective products.
- Events Outside Our Control
12.1 We are not liable for delays caused by such events.
12.2 These include events beyond reasonable control.
12.3 Obligations are suspended during such events.
12.4 Contracts may be cancelled if delays exceed four weeks.
- Your Right to Cancel
13.1 Orders may be cancelled before manufacture or service commencement.
13.2 Made-to-measure Goods cannot be cancelled once production begins.
13.3 Services may be cancelled with 30 days’ notice.
13.4 Immediate cancellation rights apply in defined circumstances.

14.1 We may cancel due to events outside our control or stock unavailability.
14.2 Services may be cancelled with 30 days’ notice.
14.3 Immediate cancellation applies for non-payment or material breach.

- Other Important Terms
17.1 Rights may be transferred with notice.

PLEASE NOTE
Delivery, Inspection, and Installation
Access issues must be reported in advance. Additional delivery costs due to access restrictions are the customer’s responsibility. Unloading is solely the customer’s responsibility. All deliveries must be inspected immediately, and damage reported within 24 hours with photographic evidence.
We do not accept responsibility for installation. Third-party installers are engaged at the customer’s risk. Ground preparation must comply with manufacturer guidelines.
